promotion with relaxation in rule defined for promotion

i am working as JE-1 in HVPNL and govt of Haryana under taking .i am hearing handicapped and comes under handicapped category in our dept.there is rule that after 5 year of service and passing safety code test a JE is promoted to JE-1.now Haryana govt issued instruction for promotion of handicapped employee with deemed date promotion .as per these instruction dept issued deemed date promotion order from JE to JE1. i did not get deemed date promotion due to late passing of Safety code test, due to which i lost my seniority from 2nd place to 6th place and also missed chance of further promotion. I requested my dept. to give me one time relaxation promotion rule but dept rejected it . Can i challenge it in High court .
