A friend lent me 11k in parts and some of the amount being as help/crowdfunding for rent paying in 2nd lockdown. I have been unable to pay the amount back as I was facing issues with getting salary from my last employer. However, she went out of the way and contacted the people I know and asked them to contact me to return the money or she will file a case. I explained the situation but later lost my job and was jobless for 6 months. Now, when I promised her to return the money next month, she won't agree to the same and treatens to file a police complaint.

She trying to file a police/criminal case for lending money to you will not stand chance in the court of law unless you have defrauded her which is not the case here. The police might not even entertain her. But yes she can always file a civil case to recover her money that was lent to you.

A.If your friend files a police complaint, you should better be ready to pay her the amount or convince her to settle the matter among yourselves. Or, if you think she might proceed with a civil case against you, then you can file a caveat petition under section 148A of the Civil Procedure Code, 1908. It is a precautionary measure undertaken by an individual anticipating that another individual may file an application in a suit or proceeding instituted or about to be instituted against him/her in the court.
