My mother's property was rented out and the tenant with the valid rent agreement. However the tenant forwarded the property to someone who has stopped paying the rent from last 3 months. He has not been vacating the property in spite of multiple notice. We tried to get help of elder helpline but they are also not doing anything. Kindly suggest what could be done in this regard

A.Dear Sir,
Sub-tenancy is illegal unless permitted in the rental agreement. On that ground your mother may get issue a legal notice and get vacate the premises by going to the Civil Court.

A.Dear Client,

If the tenant does not comply with the legal grounds and refuses to move out, an eviction procedure could be started. Valid grounds for moving the court for eviction are the failure to pay rent and refusal to move outpost the end of lease period. Hence please consult a lawyer near you to understand how to proceed legally.
