My father and brother signed in 10 Rs sale deed in 2019 for 6 bigha land sale.The witness of the agreement has died.Till 2022 he paid 90% amount.But now we want to own that land by refunding more money to buyer.He is ready to file a civil and criminal case against us and seeking signature of seller for registration and sell permission.Is it possible to get it back from him.They have not put signature in any documents except that 10 Rs deed.

A.Dear Sir,
It is invalid transaction and either of the party cannot get any benefit out of it and it will be rejected in the Court.

A.0Dear client,
The amount of the sale deed depends upon the value of the property in the matter. It will be easier to tell if the signature is valid or not only if we know the property's value. Considering it as valid, he has all the rights to sue you in that case. You guys have agreed for a contract and it is executed. 90% of the contract is already performed (payment) and hence he is the rightful owner and you cannot claim any rights over it. It is only possible for you get the rights over the property is when that person agrees to re-sell it to you.
Or else you have to prove that the contract was invalid by creating some pieces of evidence. Please contact an experienced lawyer to start the proceedings.
