Jurisdiction DV - My wife left my place
I live in Bangalore. My wife left my place and went to her parents place in hyderabad. Our marriage happened n 2014 in pondicherry but my in laws moved to hyderabad n 2017. But since they have influence in pondicherry, my wife filed DVC against me and parents in pondicherry and indicated she is temporarily staying gin pondicherry which is not true. Is pondicherry a right jurisdiction?
A.Dear Sir,
On the ground of jurisdiction you may go to High Court and get a stay order since she has created an imaginary territorial jurisdiction to give trouble to you in Pondicherry.

A.Dear client,
If your marriage is solemnized under Hindu Marriage Act, 1955, Section 19 will be applicable and it clearly says that the place where the marriage was solemnized is also a place where a divorce case can be filed. You won't be able to challenge the jurisdiction. But ask your lawyer to attend the hearing once and let him request for transfer of case to Bangalore or any other place of your convenience.
