Building materials outside my house

My house is under construction for which building material is kept in front of my main gate outside the campus. On the basis of a fake complaint some person from municipality visited my house and forcefully asked to remove the building material within 24 hrs. I told them its in front of my campus and construction is going on but they didnt given any notice in written and asked to remove forcefully in 24 hrs. Pls suggest what to do as it is not possible to remove within 24 hrs . They threatened to seize the material without any notice

A.Dear Sir,
You immediately approach Civil Court and get a stay order in the mean while approach higher authorities of municipality and ask them orally to restrain municipality from taking any illegal step without issuing notice.

A.write a letter to jurisdiction commission or top most higher officer, explain the situation and make alligation that the junior officer are threatining for bribe.

A.Dear client if they didn't issued any notice against you and your construction material under your premises then you can take action against them with filing police complaint.

A.What is your location,You have to obtain prior permission or intimate the municipal authorities before storing building material under the law.They can also seize the material and levy heavy penality charges.

A.Sir, no government official can seize any material without giving prior notice. Do not get affected by them but just don' t create any difficulty for others to live with that building material.

A.You should not use municipality road as your storage place of construction material. Whether the persons who came to your place and ask you to remove are the persons belong to municipality or not you should enquire first. If they are not fake officers, they got every right to demand you to remove construction material from municipal road. You should obtain permission from local building inspector for temporarily storing you construction material on municipal road. You should request him to give you time to remove material otherwise authorities will remove themselves.

A.By advocate Rameshwor dadhe dear sir you cannot keep any material on the way. Because it is against the public interest. If concern department can be taken action against it . But common people also oppose it .

As per your sayings, although the material has been placed in front of your premises, still the same is not on your own premises. Placing any material on the public land is considered as nuisance in the eyes of law, even if the same has been placed in front of your premises and not in front of some other's premises. But the municipality can't take any action against you without serving a notice, unless the nuisance is of such an extreme nature which require immediate action to be taken. If the self-declared municipality officials are threatening to seize the material, you should immediately lodge a report before the concerned police officials stating therein that a few unknown persons were threatening you to seize your building material. Don't even mention in your complaint that the said persons were municipality officials because they have neither served any notice upon you nor produced any other document which prove them to be the municipality officials. Hence, you are not even sure that whether they were genuine or not. You can also file a civil suit of trespass against them if they tries to seize the same. For more information, kindly contact a good legal practitioner from the Vidhikarya platform having expertise in civil matters.

A.U don't have any right to keep construction material on road As per the orders of National Green Tribunal , keeping uncovered construction material on road can be seized immediately and person doing so can be immediately challaned.
