Gift of undivided property
My father had purchased a land in 1983 in his self income and register in both name father and mother. My mother is a house wife, has no income. He make G+2 building by his income and I have helped him to make 1 and half floor for construction, he agreed it. Now my mother intended to give ground and 1 floor to my brother, only one floor to me.
But my father intended to give me half of the property and haft to brother.
My father, mother one brother and one married sister all are alive.
My question is:
can my father will/gift his undivided 50% share of property to me with out consent of my mother and brother and sister?
A.Dear Sir,
You are entitled for equal share in the 50% share of your father. But you cannot claim any share in the remaining share of your mother during her lifetime

A.Dear client,
As long as the property is self-acquired, you father can leave it to whomsoever he wishes to, through a will. However, it will be better to mention in the will the reason he do not want to give it to the other children as it will reduce the chances of the will being contested by him or her.
