oral partition - in 1978 in mutation entry oral partition - in 1978 in mutation entry

in 1978 in mutation entry it was mentioned that since 25yrs back they are staying separately.1is having 1/2 share other 2 are having 1/2 .There is no .. memorandum of partition. Family was staying till 1994. Now the 1 who get 1/2 share claiming that as per mutation entry there is partition. can court decide it is not partition?

A.Dear Sir,
Yes, Court will decide who is entitled for remaining half share if nobody is there it must be given to you.
