I am having 2 flats in a society. one is in my fathers name, and one in mine. i have car from last 5 yrs. its parking was charged in the maintenence of flat of my fathers name. this stilt was alloted to me 6mnths. back. now the cars have increased. and the society wants to re-allot all parking.
i have rented out the flat in my name, and the tenant is not having a car, only a bike.
the society managing comitee is saying tht. 1) name of the flat owner and car owner on rc book has to be same. they will not allow /allot to cars in family members name??
2)because i have rented out my flat in my name i cannot park or get allotment of car.
3)why cant. i nominate my 1 car from my 2 flats one in my and other in my fathers name for allotment??
that will increase my chance of getting allotment of stilt. is it not right

A.Dear Client,
Please go through the Sale Deed/Contract when you purchased the Building from the Builder.I hope this must have been written clearly and categorically as it is a routine matter.The space allotted to you is yours. If you feel that you are right then you have to bring it to the Notice of the Housing Society Management Committee and if you are not convinced you have the right to go to the Court of Law.

A.By advocate Rameshwor dadhe dear sir go into the sale deed . Builder can allotted all facilities to the individual flat owners. They are provided parking lot all flat owners . Otherwise you can file case against the builder as well as society management body

A.They can not restrict you from parking space. It does not matter whether you enjoy your facility or not. If the space is allotted as per the agreement then the new rules are in contravention. You can move court for injection against them
