Gratuity - Can I claim gratuity
Can I claim gratuity if i have completed 4 years 9 month. In company
A.As per the Payment of Gratuity Act, 1972, an employee is eligible for gratuity if they have completed a minimum of five years of continuous service with an employer. However, if an employee has completed at least 4 years and 6 months of continuous service, they may be eligible for a pro-rata amount of gratuity.
In your case, since you have completed 4 years and 9 months of continuous service, you may be eligible for a pro-rata amount of gratuity. The pro-rata amount will be calculated based on the number of years and months of service completed.
The formula to calculate the pro-rata gratuity amount is as follows:
Gratuity amount = (Last drawn salary x 15/26) x (number of completed years of service + any remaining months of service/12)
Thank You
