Regarding issuing of Transfer certificate by school

If any student of class-5 do not get the qualifying marks in their final exam and hence he/she is promoted in next higher class by the Principal on the liberal/sympathetic consideration ground. 1) Can guardian apply/take Transfer certificate from the school to enrol their ward to another/new school ? 2) Can school deny to issue Transfer certificate as the principal showed liberty/sympathy to the ward for promotion in higher class ?
