Dear Sir/Madam,

Myself Mr.Pavan Kumar raj urs C (s/o) late Mr.Chalapathy raj urs aged 29yrs working in an Private company, I have my mom and sister (married 11yrs ago).

My dad has build an house around 18yrs ago and its a property which he built by his hard earned money, Unfortunately my dad passed away on 13/08/2013 (10yrs ago) due to heart attack. I'm the youngest son and my sister is eldest, after my dad's death we didn't transfer the property to mom, hence still now we all 3 have equal share on property as per the law.

My mom has a debt of 35lakh & we have a 2 floor property which has 6- 1bhk houses and all are held for lease (total lease amount- 35lakh), so overall debt is 70lakh and I'm the only salaried person here.

Our property will worth approx 1cr and I'm not willing to sell it at any cost due to my father's memories and bonding, Recently we got to know about mom's debt and we're still in shock.

Now in this hard time, my sister is creating a dispute asking for the settlement of property share and not willing to take part in my mom's debt which is not fair.

I've planned to take loan of 50lakh against property and release my house lease which will provide me around 40k rent/month and along with that I've to put 20k from my salary which in total 60k EMI for 10yrs of tenure.

My sister is not agreeing to sign for release deed nor she is not ready to take part in my mom's debt, please suggest a solution for this issue. She is demanding 15lakh to sign for release deed but I can give her only after she does the signature and after getting the loan.

A.Dear Client,
There is little that can be legally done if an individual does not consent to sign a deed. However, it is advisable to consult a property expert advocate in this regard.
