House given on rent to BSNL for office
House (we also staying in same house) given on rent to BSNL for office and Tower from last 20 years(each 5 years rent agreemnt renew). Lates rent agreement expired on Oct. 2022 (no agreement renewal done by us and we dont want to continue now, becas house is old and need renovation, daughter got cancer from last 3-4 years and feels health problem due to tower and machines in house)... from last 2 years sent many letters to BSNL District authorities to vacate our house, sent letter to collector office, SP office, Nearby Police thana also for 'BSNL not vacating our personal property', sent Legal notice also to BSNL in which given 15 days (till 10th April,2023) notice period to evict the house, till now no response from BSNL, they have not given rent also from last 2 years, every time BSNL TDM says that "your case we sent to higher authority (Indore zonal manager office) to decide, whetver they decide then only we can do something, meanwhile pls manage" and now a days they are saying that "we are searching other house/property to relocate office & tower give some time"
Now my query is:
1. should we wait or file Eviction suit in court ?
2. Can we switch off machines power if they delay more to evict house ?
3. can we file any other case also against BSNL ? (on ground of 'risking public property by not vacating house timely after expiry of legal agreement' because our house has little open area around BSNL machines, and renovation to be done as house is old, so machines might get damage or stolen, and we need house for personal use, and having serious health issue... all this points we have already communicated to BSNL but still not vacating)
4. Any other quicker way to force them to vacate or 'switch off machines at least' until they relocate from our house? (as court cases usually takes very long time to decide)
Please let me know.. Land lord is 66 years old lady.
Thanks,
Nirmala
Proceed to file a notice since they are not responding to your requests. This may go on indefinitely. Don't switch off machines, as its violation of their right, and can get you in trouble. Hire an advocate in this regard and consult the same as property laws differ from state to state basis.
