Hi Sir,
Recently Family court has ordered 15k per month since starting from date of petition i, e 2017 onwards. I do not have any assets, property and no job. I am studying graduation 2 year now. I am totally dependent on Parents. But Unfortunately court ordered the high maintenance order.
Actually, my wife deserted me without any cause, we tried to establish her willful desertion but the order was pronounced against us.
My concern are,
1: after the execution petition for arrears of maintenance. Can one month imprisonment can layoff all the past arrears of maintenance due. Because i cannot pay such huge amount.
2. Will high court allow my stay order/appeal petition in high court without depositing any amount of arrears.

Kindly suggest me as i do not want to pay her and also i was already in debts.

A.Dear Client

One month's imprisonment will not clear all the past arrears of maintenance due. The court may require you to pay the arrears along with interest before releasing you from jail. The High Court may not allow a stay order/appeal petition without depositing any amount of arrears.I will advise you to consult a lawyer to understand best options for you.
