Land buy advance refund Land buy advance refund

Dear Sir/Madam,

We planned to buy a property in Chennai. So we gave 5.5 lakhs as advance. Now the property have legal issues. So we dropped the property. 2 months gone the builder is not returning the money. He is telling once i got advance from anyone i will settle your amount. If your want you can put case against me. We have the govt paper written agreement proof of giving money and voice recordings conversation of the builder.

We have 3 sale agreements. Land cost is 34.5 lakh. So for bank we put sale agreement for 30 lakhs on June 11 2018 and gave one lakh as advance for loan processing. Then through government stamp paper we gave 4.5 lakh ( 3 lakh cash and 1.4 lakh as cheque ) on 29th June 2018. Second agreement is not given to bank .

Then in July 2018 power details is not properly mentioned in the first agreement so the bank asked us to put the 3rd agreement . We signed in the xerox copy of the 3rd agreement not in the main copy till now.

Since there is 3 sale agreement the builder is not giving our 5.5 lakh. He is telling go and do whatever you want. Please help me on this . I am so grateful to you. Thank you.

Thanks and Regards ,
Joe
