Even after depositing the full fees in the college, if the student is not able to pay the fine amount, then can he not be allowed to fill the exam form and can he be thrown out of the college?

A.Dear Client,
Now right to education is a fundamental right under Article 21A of the Constitution for the children age between 6 to 14.
Although the right to education for higher studies beyond the age range isn't expressly mentioned in the fundamental rights, still Article 38,39(a), (f), 41 and 45 of the Constitution make it obligatory for the State to provide education to citizens of all ages irrespective of caste, creed, sex, religion and income. Article 26(1) of Universal Declaration of Human Rights(UDHR) proclaims that everyone has a right to education.

Being the above stated proposition of governing law of the land, the action taken against you by your college for non payment of fine, prima facie appears to be highly arbitrary, discriminatory, harsh and unjustified too so far your career is concerned.

Reach out to Higher Authority of Education Department concerned and make a written complaint explaining therein all the facts and nature of arbitrary and unjustified action of the College exploiting your career that causes infringement of your right to education too.
In case no suitable response received, nock the door of Consumer Court as now educational institutions comes under the purview of Consumer Court.
