One of my friend send me 25k $ n some gold jewellery in a parcel,the parcel reached in Delhi international airport,the airport authority demands me money for custom clearance n other procedures,I send the money around 3,34,000 rupees…. Then they again told me that I have to pay again 5,50,000 to them for convert the dollars to Indian rupees… but I am aftaid to pay,and also I don’t have money… So I refuse to pay, Now my question is if I able to get the refund money whatever I pay already… I am vey much worried about that….please help me

A.Hello,
Yes. If any excess duty is paid on export goods, an application for refund of such duty should be made before the expiry of six months from the date on which the proper officer makes an order for clearance of goods for export. (Section 26 of the Customs act 1962).
Also as per section 27 A of the Customs Act 1962 if the amount due is not refunded within three months from the date of receipt of the application by the department, interest is payable on such refund amount from the date of expiry of three months of the receipt of the application till the date of refund at the rate of 15 per cent per annum.

Any order passed by the Commissioner (Appeals), Appellate Tribunal or any court against an order of the Assistant Commissioner of Customs shall be deemed to be an order passed under sub-section (2) of section 27 of the Customs Act, 1962 and the interest is accordingly payable.

A.Dear Sir,
It may be impossible for you to get back your amount which you had paid which goes to show that you have admitted that your friend had sent those items to you.
