My father passed away without registering his will. He had 16 acres of ancestral agricultural land (which he got from his mother, (our grand mother) by succession) in Uttar Pradesh, which as per rule may now be equally divided among legal heirs i.e my mother, my elder brother and me.

# My mother is 84 years old and not in a good state of mind due to old age,
# My mother lives with me and my family and we take good care of her and bear all her expenses,
# She is very easy to come under influence on emotional basis by our distant relatives, and has already given away lot of money to them without us knowing,
#We are afraid that she might also give away her share of above mentioned agriculture land to some one without our consent,
Is there any way by which we can stop her from giving away ancestral agricultural Land?

A.Dear Sir,
You may file partition suit and take injunction order against each of the co-sharer not to transfer their undivided shares in the joint family to any other sharer or third person.

A.Dear Client,

Ancestral property including agricultural land cannot be transferred to anybody without the consent of legal heirs. If anybody acquires such ancestral property from legal heirs by undue influence or otherwise taking the advantage of his/her adverse health or mental condition. he or she may face legal consequences once the matter is brought to the notice of the Court having jurisdiction over the property.

A.Hello,
As per the information you have given you need not to worry an ancestral property can not be divided in anyway except succesion i.e legal heirs
