I have bought home loan from idbi 6 years back. They have intimated after 3 years through by original documents were destroyed in fire accident, Mumbai.I want to know that what is the right time to file a case against the bank regarding this issue. My total loan period is 15 years.Already I have completed 6 years EMI.

Now it is early the best as you will loose ground on limitations

A.Dear Sir,
You may immediately lodge complaint with Police and get a legal notice for compensation and you will get the compensation since they are suppose to ensure all such important documents. They will get big compensation from their insurance companies and in turn they may give you compensation. Further, you can approach the concerned Sub-Registrar office etc and get duplicate certificates of originals on the basis of FIR.

A.Dear client

It is the Banks responsibility to compensate you for the loss of original documents. Since Bank has reported the matter to you, you just inform in writing the Bank that they should arrange for delivery of original documents which were secured against the loan the loanee repay the loan and let you know their reactions.
Take the steps on receipt of Bank response.
