My late mother gifted me one floor

My late mother gifted me one floor and later signed a conditional family settlement that required some actions on part of my brorther, which he did not fullfil. As it happens, the floor gifted to me got assigned to my brother . Now he is seeking partition on base of settlement. Can I ask mesne profits/rent of the floor in question to be deposited in court, till the matter is decided.
