Non creamy layer

My father got retired 1 month ago on 29 April and now he get his pension. My father last three year income is above 8 lakh i.e. 10 lakh but my father is now a retired government employees and his pension is 6 lakh per annum so am i eligible for non creamy layer as required documents for non creamy layer is last 3 year income which is greater than 8 lakh per annum but for the financial year 2023-24 my father annual income is less than 8 lakh , so am i eligible for non creamy layer ?
My father is an class 2 government employees but at the time he joined he was a class 3 government employee .

The Non-creamy Layer (NCL) Certificate would be applicable to OBC candidates who are covered under the Income/Wealth Test criterion. The income limit is decided on the basis of income earned during three previous financial years. The main point here is to treat income from salary and income from other sources separately. Neither salary nor income from other sources should cross Rs.8 lakhs in three consecutive years. Check your parent’s salary for the last three consecutive years. If in any of the last 3 years, it is below 8 lakhs, you are qualified for OBC Non-creamy layer status, provided income from other sources is also less than 8 lakhs. With regarding parents under Government employment, the status of the job (Group A/B/C/D) is more important than the salary. If your parents are earning more than 8 lakhs but their rank is below that of group B officers, you will still come under the Non-Creamy Layer. For more detailed information you may contact the office of the Tehsildar or SDM who are the competent authority of issue of caste certificates.

It will be decided by concerned officer who will issue certificate if his decision is against you. You have an option to approach higher authorities or high court.
