My school is not giving my 12th class marksheet and TC because I have fees dues
What can I do in such case
And if I take the matter to court how much time would it take

A.Dear Client,

A school affiliated with a Board or institution having standing rules applicable to all students irrespective of class, caste, or creed that require clearance of tuition fees lying outstanding to get the TC and Final mark sheet, a student is dutybound to abide by the said rules to obtain the said documents from the School. If for some financial constraints, if any student is unable to meet the dues, he may approach the Head of the Institution for consideration of his appeal, failing which the student may write the District Inspector of the School, the Education Deptt, for a resolution in the matter. A Court may not entertain any suit if no discrimination is caused and noticed on the face of the record.

A.Dear client,1.
We would advise you to meet the Principal of the school in person and request the TC to be given

Draw attention to the provisions of section 5 of right to education act wherein Head teacher or teacher in charge is required to give immediate TC certificate. Failure to give TC certificate invites disciplinary action against said head teacher

If they still deny , issue a legal notice to the School authorities asking them to issue the School Leaving Certificate. No School can bound the student by a bond or ask them to pay money if they want the child to study in a different school.

As per the Right to Education Act, no child should discontinue education because of the delay in issuing a TC.

If the authorities of the school failed to issue the TC even after a month, the same should be brought to the notice of the deputy director of public instructions or the block education officer, and they should take action as per the classification control and appeal (CCA) rules,
