I have a house in delhi. The walls in my house experience heavy leakage due to the bad flooring in the house above us. I asked him to get it fixed but he doesn't respond. I even tried to complain in the police station but as you know they are useless. What should i do ?

A.Dear Client,
In case it is a housing complex run by a registered Society, then you bring the matter to the notice of the society for a resolution in the matter or in case of failure on the part of society to resolve the issue you can bring the matter to the notice of the Registrar of Society inviting his intervention into the matter for appropriate resolution in the matter.

A.Dear client,

Communicate in writing: Document your communication with the owner of the upper house. Send a written complaint or notice to them, clearly explaining the issue, the damage caused, and requesting them to take immediate action to fix the flooring and stop the leakage. Keep a copy of all written communication for future reference.

Mediation or Arbitration: If direct communication doesn't resolve the issue, you can explore mediation or arbitration as alternative dispute resolution methods. These processes involve a neutral third party who can help facilitate a resolution between you and the owner of the upper house. Look for local mediation or arbitration services that can assist in resolving the dispute.

Consult a lawyer: Seek legal advice from a lawyer specializing in property or housing laws. They can guide you on the specific legal options available to you, including sending a legal notice to the owner of the upper house, filing a civil suit for damages, or seeking an injunction to stop the leakage.

Report to the authorities: In addition to the police station, consider reporting the issue to the appropriate local authorities, such as the municipal corporation or housing board. They may have departments or officers responsible for handling complaints related to property damage or building maintenance. Provide them with all relevant details and evidence of the issue.

Collect evidence: Take photographs or videos of the damage caused by the leakage, as well as any correspondence with the owner of the upper house. This evidence can be useful if legal action becomes necessary.

Seek assistance from the residents' welfare association or society: If you reside in a housing society or have a residents' welfare association, inform them about the situation. They may be able to provide support, mediate the issue, or guide you on the appropriate steps to take.
