Can an employee out of their own choice and willingness resume to the office before the completion of maternity leave? if yes, then please provide me with a precedent.

A.Dear Client,
So far your query is concerned there is no specific provision under Maternity Benefit Act, 1961. Since the office can not compel you to join during maternity leave, If you join the office at your own before the completion of your maternity leave period, your maternity leaves and other benefits automatically get cancelled. So if you need to do some office job during the maternity leave period, do it as obligatory rather than formally joining the office otherwise you may lose the benefits available under the Act.
