यदि जमानतीय वारंट को तमिल करने मे पुलिस अफसर अपयशी होता है, और अपनी report मे यह लिखता है की आरोपी घर पर नही मिला, उनकी धर्म पत्नी और बच्चो ने कहा की वह घर पर नही है। यदि इस तरह के report अफसर द्वारा कोर्ट मे दिया जाता है तब क्या यह कानूनी प्रक्रिया और कोर्ट की मर्यादा का अलांघन नही है?? इस की तकरार यदि पुलिस मुख्यालय के अधीक्षक को कर दी जाये तो क्या वह पुलिस अफसर suspend होगा?? इस पर कोई CITATION चाहता हु

If the police officer fails to execute the bailable warrant, and writes in his report that the accused is not found at home, his wife and children say that he is not at home. If such a report is given by the officer in the court, then is it not a violation of the legal process and contempt of the court?? If this dispute is made to the Superintendent of Police Headquarters, will the police officer executing the warrant be suspended?? I want a CITATION on this

A.Dear client,
The police officer is liable. According to Police Act, 1861 S.28 covers the same saying that every police officer who commits a duty violation, neglects to follow a lawful order or regulation issued by a competent authority, resigns from his position without authorization, engages in lawful employment outside of his position without authorization, is cowardly, or uses unjustified personal violence against a person in his custody will be held accountable upon conviction before a Magistrate.
