My maternal grandmother has been subjected to constant mental abuse for two years now after his husband's death by her son and daughter in law. The flat she owns is her property, none of the former people have any rights on the property. However they wish to get the house to themselves and are after her slowly subjecting my grandma to mental illness. The daughter in law threatens her daily and a lot more terrible things. If anyone could give advice on the matter pls help the old lady.

A.Dear client,
There are few constitutional provisions and laws which offer protection to safeguard the rights of elders and prevent their abuse - Article 38(1), Article 39(e), and Article 41.
There are few legislations protecting the rights of elders:
Hindu Adoption and Maintenance Act, 1956 - This act empowers elderly people with a legal right to claim maintenance from their children.
The Code of Criminal Procedure, 1973 - Section 125 of the Criminal Procedure Code allows maintenance to parents and wife which indirectly covers the interim maintenance of elder parents ensuring the economic security of the elders.
The Maintenance and Welfare of Parents Act, 2007 - This act seeks to make it a legal obligation for children and heirs to provide sufficient maintenance to senior citizens, and proposes to make provisions for state governments to establish old age homes in every district.
