hi there,
My father is an IES govt employee, he is retiring from his duty with in 3-5 months, me, my brother and my mother have been separated from our father since 2004 by means of an agreement no divorce was given, my father is living there with his second wife since then, it is written that on my fathers retirement income my mother has same rights as my father has. now he is denying from that. we dont know how much income he is gonna get at the time of retirement and what should be our steps ? and can we get 50% or greater amount from department directly ?

A.Sir,
You verify the pension nominee of your father.Recent supreme court rulings are very much supporting the rights of more than one female wife and including illegitimate children for pension benefits. Possible lodge a claim petition before your fathers office

A.What is the terms agreement?. Without divorce & first wife living then, if he has married it is illegal for Govt. Servant to have second wife.What his office record says?. In both the cases the Legally married wife with record & nomination get all the benefits .It is better to consult a Lawyer to make claim & protect your interest.

A.Second marriage without divorcing first wife is illegal and offence.So second marriage is not valid as per law.However in order to get the retirement pension benefit of your father to your mother in future, intimate the status and details of your mother to the concerned office of your father.
