Can a Dy. Registrar's decision to not take action be appealed before Jt registrar under Sec 154?

Hello, I wish to know if the decision of a Dy. Registrar to not take action under Section 79A(3) of the MCS Act be appealed before the Joint Registrar under Sec 154. The Dy. Registrar claims actions under Sec 79A(3) is not required as he is taking action under Sec 77A. However, the quantum of penalty under Section 79A(3) is six years whereas under Sec 77A, it's only appointment of administrator for 6 months. Please advise.
