would like to know the procedure to get my child's passport as a single mother.
Since 2011, I've been working in the UAE. I got married in 2016, separated in 2018, and am not yet divorced. I was in a living-together relationship when I got pregnant in 2023. Since my partner was not ready to accept the child, I decided to raise the kid alone. I resigned and left the UAE last October to do the delivery in India.
I have researched whether being a single mother is possible in India. It is Valid on the internet, but after delivery, it is a must to provide the child's father's name as mandatory in the birth certificate application. Since I had no choice, I gave my ex-husband's name to get my kid's birth certificates. After the BC was issued, I tried to remove my ex-husband's name in order to apply for my child's passport, but it didn't happen.
I wanted to travel back to the UAE with my kid and apply for his passport as a single mother. Is it possible to get my child's passport without the father's name? If yes, I would like to know the procedure.

The documents required are proof of present address, proof of date of birth, attested photocopy of passport of both or either parent and a declaration affirming the particulars furnished in the application about the minor.
In the case of minor children of unwed single parents, the name of the father or mother is not required to be mentioned in the passport application and in the passport. A single mother can submit the declaration as Annexures C and D while applying for the minor's passport, and the section for the father's name can be left blank. But in the absence of a decree of divorce, your marital status cannot be treated as unwed. The Supreme Court, through some of the leading cases, has stated that as per section 16 of the Hindu Marriage Act children born out of a live-in relationship will be considered to be legitimate and should be given the status of “legal heirs” and are entitled to the right to inherit the property of both the parents. So, in the given situation, you need to verify your entitlement to apply for your child's passport from the Passport Seva Kendra (PSK) for further clarification and steps in this regard.
