My vrs was accepted by bank w.e.f 30/11/2021 but in the meantime a enquiry regarding procedural lapses started and outcome of which was acknowledged by me as warning not to repeat such act in future on 6/2/2023.Now that everything is clear, they are not relieving me. I have mentally weak and now feel unable to continue in service. What to do

A.Dear Client,
Your resignation under VRS even if it is accepted w.e.f. 30/11/2021 was put on hold and kept in abeyance on detection of misconduct of procedural lapse. The inquiry into said misconduct was carried on by the Inquiry Committee and based on the report of IC, you were issued a warning letter on 6/2/2023 by the Bank discharging you from the allegation. So, on cessation of your employment with the bank on acceptance of VRS w.e.f. 30/11/2021 and your discharge from the allegation on 06/02/2023 now put the Bank in an unethical dilemma with regard to the delay in issuing of relieving letter on acceptance of VRS and disbursement of F & F Settlement of dues. If the Bank relieved you from a back date, they are liable to pay interest for the delay on the claim, and since you were not in employment during the period they cannot relieve you after the date of issue of the warning letter acquitting from the charge/show-cause. In the prevailing situation, you need to bring the matter to the notice of the concerned Labour Commissioner for an amicable settlement of dispute protecting your interest failing which you may file an application u/s.33C(2) of the I D Act before the concerned Labour Court claiming your F & F Settlement dues from the Bank. You can also escalate your grievance before the regulatory authority RBI online on the portal (https://cms.rbi.org.in) for a resolution in the matter.
