A.Dear Sir,
It is mandatory on the court to direct the tenant to deposit the arrears before contest the case orelse summarily can pass eviction order.

A.Sir, you need to propose before the court that you want your tenant to vacate the place on the following grounds

1. The tenant was not paying the rent amount timely
2. After the institution of the eviction suit, she paid rent for 2 months only, thereafter paid nothing.
3. That the court had ordered the tenant to pay rent on a timely basis but the tenant is not following the Ld. Courts orders.

On the basis of the above grounds and prayers made by your Ld. Adv the court [if satisfied] with such contentions so made will pass necessary order/orders as it deems fir and proper.
Hope this helped

Sir, if she is not paying you the rent then you need to pray for the same before the Ld. Court stating that even after the order of the court she did not pay and as such she did not obey the Ld. Court. The court after such examination will thereafter ask the other side to justify such delay [and only if it is justifiable] will it allow the same. On the contrary if your lawyers are able to prove beyond reasonable doubt that such delay was made to harass you and to litigate this matter further and not get you the possession of the flat the court may resort to eviction.
