Execution of Agreement of Sale.

We've purchased a flat in Hyderabad. The agreement of sale is on my My Name and wife name. Can I do flat registration on my name ? Builder is not favour of doing registration on my name. All the payment to the flat purchase is done by me.

When an Agreement to Sale is jointly executed by you and your wife, until and unless a revised/amended Agreement to Sale pursuant to an earlier agreement is executed on receipt of NOC from your wife, the earlier agreement even it is unregistered can be treated as a piece of evidence to invoke the relief under specific performance. So, without execution of a revised or amended Deed of Agreement to Sale, if you go for registration of a Deed of Sale in a single name instead of a joint name, it may be a cause of dispute and legal consequences in the future. As long as Sale deed is not registered you can get the name changed in the deed and there is no law or legal procedure required for that. Its just that you have to change that page and again both the buyer and seller will have to sign all the new Sale deed.
