Hi, I am planning to sell my 13 years old flat. I bought through loan and completed it. Now I want to sell it. I am ready to give all documents copies such as Sales deed, construction agreement along with all parent documents to the buyer for legal verification. Post verification I asked him to make a sales agreement with 20% advance payment. The buyer wants to verify the orginal parent documents before entering the sales agreement then go for bank loan. Pl guide me when and whom I should show the original parent documents to the buyer? It is with Apartment association, I told him I can show my sales deed and construction agrement while making sale agreement. Pl guide

A.Dear Client,

Every potential buyer has the unequivocal legal right to request the mother deed of the property they intend to purchase, as it mitigates risks associated with potential disputes. If the seller does not possess the mother deed, the buyer can obtain a copy from the Association, and even a certified copy can be requested. The current buyer holds the right to demand the mother deed from the seller.

Original will be shown only after execution of sale agreement. You cannot show the originals to each and every prospective buyer.

A.Dear client,

It is an absolute legal right of any buyer to demand for the mother deed of the property that he/she is willing to buy. As it involves a lot of risks in case if there is a dispute in the same. If you do not have a mother deed, you can ask a copy of it from the Association. Even certified copy can be applied. The current buyer has all the right to claim such deed from you
