Car parking in independent floors Gurgaon
I live on the first floor of a three tiered omaxe independent floor building. Car parking for the three floors (ground first second) have been carved out of the area In front of my house(green belt/common area) ground floor owner parked his car in my parking (middle) so many times I ask him to remove his car but not listening. 2004 we perchaged it.
In sales deed nothing is written about parking it's only common area use for alI . So i devide the space in to 3 and enmarked it .Sir I want to know how to devide the space (leave the entrenc gate or devide total space which side is first floor parking (left /middle/right) as per huda rules. How can I resolve this parking issue.

A.Dear Client,
In cases like this, it is advisable to first review any relevant documents such as the sales deed, agreement, or any rules and regulations imposed by the housing society or the builder. These documents may shed light on the rights and obligations of each floor owner regarding car parking.

If the documents do not specifically address the parking issue, you may need to look at the local laws and regulations. In Gurgaon, the Haryana Urban Development Authority (HUDA) may have rules or guidelines regarding car parking allocation in independent floor buildings.

If there are no specific rules concerning parking, you may have to engage in a negotiation or discussion with the ground floor owner to find a mutually satisfactory solution. It is important to maintain clear communication and attempt to resolve the issue amicably.

If all efforts to resolve the matter fail, you may consider seeking legal advice from a local lawyer who can advise you on the specific steps you can take under the relevant laws and regulations. They may suggest initiating a legal action or approaching the appropriate authority for resolution.
Thank you.
