My wife filed a false DV case against me on 18 Mar'23 and and only 2 dates have passed one was 24/05/2023 and 2nd was on 13/09/2023 and I have got the third date for 06/02/2024 , why court is taking too much time , How can I Fastrack my case. I checked the other DV cases records online most are getting 1 date each month, some even 2 dates a month. One of the reason I found that Reader sitting in court is corrupt when my chargesheet was filed I was asked for bribe to speedup my bails and other procedure. Is there any way to fastrack my case or t/f my case to other judges. Please advise

A.Dear Client,
You can file a petition under Rule 109 of Civil Rules of Practice read with Sec.151 of CPC (Petition for advance hearing) by serving a copy of the said petition to the opposite party with an affidavit stating the reasons for which you seek the advancement of the hearing from that date to this date. The transfer of suits is only possible if there is a sufficient or rational cause which are as follows: Convenience and inconvenience of the Plaintiff. Convenience and inconvenience of the Defendant. Convenience and inconvenience of the Witness. Section 408 of the Code of Criminal Procedure enshrines the powers of the session judge to transfer criminal cases and appeals between subordinate courts within its sessions division.

A.Dear client,
An application for early hearing also possible. This process is also called expediting the trial of a case. The High Court has powers to direct the trial court to conclude the trial of a case expeditiously.
To transfer a case to a Fast Track Court, you need to put an application in the court to hasten the matter by expressing the causes. If the court does not get back to you, apply to the high court to suggest to the lower court.
