I am a central govt employee. My baby passed away after 38 days from his birth. How much maternity leave is admissible

In case the maternity leave has not been availed by a female Central Government servant, 60 days of Special Maternity Leave may be granted from the date of expiry of child soon after birth/ stillbirth.

While I sympathize with your plight, it is to inform you that as per the Maternity Benefit Act of 1961, the duration of maternity leave for both first and second-time mothers is 6 months or 26 weeks. This leave can be availed either before or within 6 months from the date of delivery of the child and the leave period may be extended in emergency conditions on the recommendation of the treating Doctor or the Medical Board of the Hospital. Once a woman employee applies for maternity leave, the employer is dutybound to approve her leave and disburse her all the monetary benefits available under the Act. In the prevailing situation, you can avail of maternity leave as per your requirement or necessity.
