A.Dear Client,
When you join the Company for an online data entry job then you must have a copy of your offer letter/Agreement and if that offer letter is silent on the subject or without any specific terms stating that in case you leave the job before the assigned period or poor performance of assigned jobs, you have to pay compensation for deficient or to face legal Consequences, then on receipt of a sum of Rs.5000/- towards compensation for damage or financial loss caused to the company for leaving the job incomplete and without notice, then the Company cannot take any legal action for recovery of said money from an ex-employee. Section 73 of the Contract Act makes provision for unliquidated damages (not stipulated in a contract) and section 74 of the Contract Act deals with liquidated damages (stipulated in a contract) and no compensation is attracted for mere breach of contract u/s.73. 74 of the Act unless such breach resulted in an actual loss or damage to the opposite party. So, in the given situation, serve a legal notice to the fraud entities before they serve you and bring the scam to the notice of the Police Station and Cyber Crime Cell with all the relevant documents, including a copy of the agreement you signed accepting the offer and sources of their contact to enable the investigating authority to find out the fraudsters and take appropriate action against them.
