Sir, I worked as a part time accountant in my friends office two years back. during that period he asked me to en cash an amount of Rs.6 lacs from the bank for his office payments and expenses vide a bearer cheque in my name.. I encashed it and gave him the money. In due course our relationship got messed up due to a litigation. Now, he has gone to the police and given a complaint that I have taken an amount of Rs.6 Lacs as loan from him, reqesting the police officer to retrieve the said amount from me. The police after due enquiry asked us to go to the court. as a fact there is no supportive document from my ex friends side to show it as a loan. What will happen if he goes to the court? Pls guide me thro. whether I can go for a defamation case against him if he goes to the court.
A.Dear Client
If your friend has filed a complaint against you claiming that the amount was a loan, you would need to gather any relevant evidence that can support your claim that it was not a loan but rather an amount encashed for his office expenses. This might include any communication, messages, or other documentation that can demonstrate the purpose of the transaction.
