Bike dealer took full payment in return to give the bike before delivery date Bike dealer took full payment in return to give the bike before delivery date

I paid full amount of bike in advance on 16th Sep 2023 as showroom sales executive called me to do that and they will give me the bike in between 5-10 Oct. But when I called them on 10th Oct they said bike will arrive in between 15-20 Oct. When I called them on 20 Oct then they said lot is not came will give you the bike on Dasera that mean 24 Oct. Again now they called me on 23 Oct that we have the bike which is different colour than what we choose, they said we will 100% give the guarantee to give the bike on 30 Oct or within 1st week of Nov. When I called them on 5th Nov, they said in next 2 days. Again next 2 days I visited the showroom and asked about bike, they said will give you till 10 Nov. Please advise me what should I do in this case. I have all phone recording and payment receipts.

A.Dear Sir,
You may lodge complaint with Police and produce Xerox copies of payment receipts so that Police will teach him a lesson.

A.Dear Client
Check the terms and conditions mentioned in your purchase agreement or any documents you might have signed. Look for clauses related to delivery timelines, delays, and what actions can be taken in case of such delays. Document your communications with the showroom in writing. Send them an email summarizing your discussions and expressing your concerns. Having written documentation can be useful in case legal action becomes necessary.
Given the delays and the fact that they offered a bike with a different color, you may want to consider requesting a refund or a replacement that meets your original specifications. Clearly state your expectations and the consequences if they are not met. If the issue persists, consider filing a complaint with the appropriate consumer protection agency in your area. Provide them with all relevant documentation, including phone recordings and payment receipts.

A.Dear Client,
Repeated failure on the part of dealer to delivery of vehicle on receipt of cost of vehicle from the customer amounts to deficiecy in service and unfair trade practice. Reach out to an Advocate to file a complaint against the dealer before the Dist. Consumer Commission under Consumer Protection Act over alleged dificiency in service and unfair trade practice claiming refund of value of vehicle alongwith interest and compensation for harassment. The complaint should be filed within two years from the date of cause of action.
