My husband filed RCR against me, what if I being respondent win the case? What are the consequences if I win the case

A.Dear Client,
Being the respondent if you won the RCR filed by your husband under Sec.9 of HMA, 1955, he may lose the divorce case and vice versa. However, upon completion of 1 year from the date of the RCR decree, you can approach the same court asking for divorce as RCR has failed (if both don't join back) claiming maintenance/alimony from your husband.

A.Dear Client
The RCR case means that the court is not ordering you to return to marital cohabitation. The court may find that there is no legal obligation to enforce conjugal rights if there are valid reasons for your separation. Since the court has dismissed the RCR petition, there are no legal consequences for not complying with an order to return to marital cohabitation.The dismissal of the RCR case means that the status quo continues. If you are living separately, the court is not compelling you to reunite with your husband.
