Due to some name mismatch issue, I need to do affidavit by 1st class magistrate. My question is: If I do affidavit by a First Class Executive Magistrate, will it be ok? Or do I need to do the affidavit by First Class Judicial Magistrate? Please suggest.

A.Dear Client,
Functions that are essentially judicial in nature are the concern of the Judicial Magistrates, while functions that are "police" or administrative in nature are the concern of the Executive Magistrate. So, it is suggested to swear the affidavit before the First Class Judicial Magistrate if that meets your purpose.
