A.Dear Client,
A HUF can own property, movable as well as immovable, in its name. However, a property belonging to an HUF belongs to all the members. Coparcener denotes 'Joint Heir' in a Hindu undivided family (HUF) who shares legal rights for inheriting property, title, and money as defined under Hindu Succession Laws. In a joint Hindu Family (HUF), there is a concept of joint possession of ancestral property or coparcenary. HUFs are categorized into two- Dayabhaga and Mitakshara. The former allows even the female members of the family to be concepts, but the latter insists on only male members being coparceners. Under Section 6 of the Hindu Succession (Amendment) Act 2005, a HUF governed by the Mitakshara law shall allow even daughters to become coparceners by birth and have the same rights to coparcenary as the son. When a coparcener relinquishes his/her share, it only means that he/she is separating himself/herself from the family, thereby becoming a separate entity. In light of several judgments and facts, it may be said that the relinquishment of a share in the property by a coparcener doesn't require the adjustment of diverse rights or division of wealth in substantial portions. This means that the relinquishment of one coparcener’s interest doesn’t result in a partition to the joint family wealth. His/her renunciation merely extinguishes his/her interest in the estate but doesn’t affect the status of the remaining coparceners’ share in the family property. A.Dear client
Prepare a legal document known as the "Deed of Relinquishment." This document should clearly state your wife's intention to relinquish her rights, title, and interest in the HUF property. The deed needs to be executed on non-judicial stamp paper of the requisite value. Both parties, i.e., your wife as the relinquisher and yourself as the Karta, need to sign the document. Additionally, it may need to be attested by witnesses. In some jurisdictions, registration of the deed may be necessary. Registration ensures that the deed is a legally valid and enforceable document. The deed is typically registered at the local sub-registrar office. It's important to be aware that there may be tax implications associated with the relinquishment of rights.
