I am an old customer of BSNL. I had a post paid cell phone connection. I had been to Vietnam recently. For that purpose I had approached BSNL, they collected Rs 5,000 deposit & issued an international sim & the same got activated on my reaching Vietnam. But, with in two days I got a bill for around Rs.66,000 . I might have made less than ten calls! Immediately I stopped using it later I obtained a detailed bill where in they say at the back end lot of data got automatically downloaded, hence I have to settle the bill. I was under the impression after Rs.5,000 it will stop & I am free to top up depending upon my requirement. They say it will happen in a prepaid option & not in post paid. At the time of my visit I have not given any option but, they have chosen an easy way of linking it to my existing post paid connection. I am located in Mysore, Karnataka, India. I had given a complaint 7 months back, they postponed the remedy with lame excuses & now telling that, thay provide me the option to pay in installments or else they will recover through Lok Adalat. I seek your advice to know whether I have a case, if yes which court to approach, who will handle my case, what would be the fees and the time required to get the order & reconnection.

A.Dear client,

Here if you are sure that there is an unfair practice by the BSNL and they are overcharging then you can lodge a complaint under consumer court/forum. But in your inquiry, you mentioned that you were under the assumption that after Rs. 5,000 the amount would stop and there was an assumption from your end. Here I would suggest that you consult an advocate about the strength of the case and the fees and time because that will change from lawyer to lawyer.

A.Dear Client,
As per the Telecom Consumers Protection and Redressal of Grievances Regulations, 2007, in case a consumer has a complaint, the first step is to register the complaint at the toll-free Call Centre number of the service provider(BSNL) and obtain a docket number, confirming registration of the complaint. If the complaint is not redressed then the complainant has to lodge a grievance to the Nodal Officer of the service provider failing which the complainant has to file an appeal to the appellate authority of the service provider in the prescribed form. In case the complaint is not redressed or resolved before the Appellate Authority within four weeks for lack of merit, you have to pay the outstanding bill as raised and demanded by BSNL. In case you don't pay your bill the option they have is to send you bills and give considerable time for the payment. After that, they will approach the court for out-of-court (lok-adalat settlement), In case you opt not to pay or to not respond to the court notice then further court proceedings will start. At present if you want you can contact CAO(TR) of your area and ask for some concession for clearing the payment. Remember BSNL has the government backing with it. So it is advisable whatever is the o/s bill dues, pay it and officially disconnect the connection to save yourself from future harassment and legal consequences.
