A person living in my neighborhood has been abusing my father (64) indicating our house for the last one year.
Sometimes he says that we have taken his wife and daughter, when his wife is at home.
Always heard his abuse. What can he do in this case? Police complaint was given, police took no action.
One day he broke the door of our house at 12 o'clock in the night. Despite repeated requests to his wife, she does not get him treated.

Can we file a case against him or his wife? We and the people living in our neighborhood are witnesses. Even now he is abusing my father indicating our house , while I am writing this question.

A.Dear client,
If the person is severely ill as in terms of mental issue, then case against him won't stand.
First you have to inform this matter to the local authority of your area, like the councillor or the panchayat or any subordinate body.
Secondly lodge an FIR against that person.
Thirdly you can file a case against the wife for allowing such harassment to be executed.

While I sympathize with your plight, it may be suggested at the moment that 1) Serve a strong legal notice to the errant neighbor asking him to refrain from his violent conduct failing which he may face legal consequences, 2) file a written complaint against the errant neighbor before local police station endorsing a copy of the complaint to SP, DSP, DM, SDM and if the situation so arises dial 100 for help to protect your family from immediate threat to life and property. 3) File a criminal suit under Sec.268 IPC for public nuisance and Sec.503 IPC for criminal intimidation and Sec.499 IPC for defamation against the errant neighbor including his wife who supports the criminal acts, 4) Apart from this, An Elder Help Line (No.14567) is launched by the Ministry of Social Justice and Empowerment exclusively for the protection of the interest of Sr. Citizens of the Country from any kind of crisis from health to wealth, you may take a chance by contacting them through helpline number to resolve the issue and approach the Chairperson, Human Rights Commission of the State who on receipt of a complaint from a citizen under distress takes suo moto action in the matter. Reach out to an Advocate for guidance and steps.
