Hi My name is Farhan
I applied for a passport in 2017 and it got approved with my mother's name written on it as 'Rukaya Akhter.'
It was then mistakenly written with the surname 'Akhter'
However, all my subsequent documents (10th certificate, birth certificate, and 12th certificate) only mention my mother's name as 'Rukaya' without her surname 'Akhter.' On the contrary, all of my mother's documents include her full name 'Rukaya Akhter.'

Now, I'm applying for a passport reissue to remove the ECR (Emigration Check Required) category. However, the passport officers informed me that they can't proceed because my date-of-birth certificate doesn't include my mother's surname 'Akhter,' while my current passport has her full name. They suggested either adding the surname to my documents or removing the surname from my mother's documents and providing those to them,

I'm puzzled because if I were applying for a fresh passport without having had one before, I could clearly write my mother's name as 'Rukaya' without her surname, as there's no rule requiring mother's documents during a new passport application.

Could you please guide me on what steps I should take?"

A.Dear Sir,
The rules of Passport Authorities being not controlled by the Hon’ble Courts also due to security reasons. Thus, you may just oblige the directions of the Passport Authorities.

Depending upon your intention to change your mother's surname you may follow the steps 1) An affidavit is a legal document that is used to state facts under oath. The affidavit should include the applicant's current name, the desired new name, the reason for the surname change, and any other relevant details declaring that the ' Rukaya ' and the ' Rukaya Akhter' are the same and one identical person. The affidavit should be made on a stamp paper of the appropriate value as per the state where the applicant resides and should be sworn either before the Notary Public or preferably before the Judicial Magistrate/Executive Magistrate. 2) The next step in the name change process is to publish a notification in the Gazette of India. The Gazette of India is a publication of the Government of India that contains official government notifications, including name change notifications. The notification should be in the prescribed format and published in at least two local newspapers. 3) After publishing the notification in the Gazette of India, the next step is to make out a name change deed. The name change deed is a legal document that confirms the name change and includes the details of the old and new names. The deed should be made on a stamp paper of the appropriate value as per the state where the applicant resides and should be signed by two witnesses and notarized by a Notary Public. 5) The final step is to submit the name change deed to the relevant authorities for information and records. The applicant may also need to provide additional documents, such as a copy of the Gazette notification and a copy of the affidavit for updating the records. It is essential to follow the correct procedure to ensure that the name/surname change is recognized by the Passport Issuing Authority and other relevant authorities.
