I am being repeatedly harassed by my supervisor ina private company. This harassment began 20 days after I shifted to a new place for my job, prior to shifting I had been working for close to 1.5 month with the same supervisor. he is not letting me meet the organizational goals by being an impediment. he has spread false rumors against me and has alienated me from other team members.

A.Dear Client,
There is no specific procedure provided in any law to deal with mental harassment in the workplace. Since mental harassment has been categorized in various forms under Indian law, the action to be taken shall be in accordance with the particular kind of harassment the victim has faced in a private organization. Since it is a very sensitive and delicate issue, the matter needs to be handled carefully otherwise you may be victimized on either pretext. Cases for mental harassment at the workplace can be filed against the superior or Company in the civil court as well as a criminal Court if you add the charge of criminal intimidation under Sec.506 IPC or charges under Sec.504 IPC that says whoever intentionally insults, and thereby gives provocation to any person, intending or knowing it to be likely that such provocation will cause him to break the public peace, or to commit any other offense, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. When you are facing such kind of mental harassment at the workplace from the toxic behavior of your senior Boss, you may bring the matter to the notice of higher authorities first and serve a legal notice to the errant Senior of the organization and thereafter you need to reach out to an Advocate for filing a criminal suit against your errant senior and the higher authority of the Company for not responding to your notice.
