A.Dear Client,
Order 1 of the Code of Civil Procedure, which deals with parties to the suit. It deals with the necessity of bringing parties to the suit for proper and effectual adjudication of the matter in dispute. Order 1 Rule 10 of Code of Civil Procedure (hereinafter referred as C.P.C.,) enables the court to add any person as a party at any stage of the proceedings if the person whose presence before the court is necessary in order to enable the court to effectively and completely adjudicate upon and settle all the questions involved in the suit. There are two types of persons who may be added as parties to the suit. (1) A person who is a necessary party i.e., in the absence of whom relief claimed in the suit cannot be granted. In other words, it means that for the grant of relief claimed in a suit, a person who ought to have joined must be added, (2) the second class of persons consists of those who are proper parties i.e., whose presence may be necessary with a view to fully adjudicate upon the matters involved in the suit. The only reason that makes it necessary to make a person a party to an action is so that he should be bound by the result of the action. Therefore, the question to be settled must be a question in the action which cannot be effectually and completely settled unless he is a party. Reach out to an Advocate for guidance and steps.
