Reliance didnt provided warranty service and also didnt replied to the notice
3 months ago
I bought kelvinator kettle from Reliance smart store in 20-01-23. Product has 2 years warranty. It stopped working on 5-12-23. I contacted kelvinator support to avail warranty service. Kelvinator support said technician will visit my residential address. A person from Reliance contacted and said unit will be replaced. I waited quite a time but no response so I contacted them many times and escalated it the Branch manager RIL contacted me and asked me to go to reliance store from where I purchased it. And informed me that Reliance store will replace the unit. I went there where reliance store manager and other staff humiliated me. I tried calling Branch manager RIL who sent me there but he did not responded. So I came back and contacted a law firm to send legal notice to reliance and kelvinator for misbehaviour and not providing warranty service. But Reliance did not responded to this notice and kelvinator 's address notice came back due to wrong address. What should I do now ? Shall I file case in national consumer court delhi ? Plz advice complete plan of action. Thanks
Consider documenting all communication, including emails, messages, and interactions with the store and manufacturer. Ensure you have proof of purchase and warranty details. If the law firm's notice wasn't successful, consult with another legal professional for guidance. Filing a case in the National Consumer Court in Delhi could be an option, but it's crucial to seek legal advice first to understand the merits of your case and the appropriate course of action. They can guide you on gathering evidence, drafting a strong complaint, and navigating the legal process.
Thankyou
In the given situation, you have to file a complaint against both the manufacturer and the seller of the product over alleged deficiency in service and unfair trade practices under section 35 of the Consumer Protection Act, 2019 before the Consumer Commission having both pecuniary and territorial jurisdiction to adjudicate the complaint made by a consumer claiming relief including compensation for harassment and cost of litigation. As per the Consumer Protection (Jurisdiction of the District Commission, the State Commission and the National Commission) Rules, 2021, the District Commission shall have jurisdiction to entertain complaints where the value of the goods or services paid as consideration does not exceed fifty lakh rupees. So, if the value of the product comes below Rs.50 lakhs, then you have to file your complaint before the Dist. Consumer Dispute Redressal Commission. The complaint should be filed within two years from the date of the cause of action. Reach out to an Advocate for guidance and steps.
