We were out of India, when we returned to our rental flat in Dombivli on December, we discovered that due to leakage from ceiling many of our household items, clothes in bags, bags, bedding items were damaged. A conservative estimate of our damages is around 30000. Flat was damp with smell, we had to stay in hotel for 5 nights and come to flat every day just to make the flat habitable. A lot of manual cleaning work followed for 2 weeks after that.
We learnt from the neighbor and building plumber that the Builder project office carried out some tiles repair work on the upper floor due to which all the flats and common area of our floor were drenched with water. This issue happened one month before our arrival, builder repaired the leakage effects of the neighbors and common area that time. But we were not here, they never reported this issue to us even though we have a resident card and they have our e-mail/mobile numbers. Our flat owner also didn't receive any communication. Builder is denying to pay us any damages.
What legal options do I have? Can any legal notice be sent to builder?
