A.Dear Client,
Proving medical negligence or professional misconduct against a doctor or medical practitioner is a challenging process often hindered by technicalities and procedural requirements. The Dental Council specific to each state issues certificates of practice to dentists who have obtained the necessary degrees from recognized medical institutions. Prior to approaching the Consumer Forum, it is essential to file a complaint with the Ethics and Penal Committee of the state-specific Dental Council. If the committee's inquiry establishes medical negligence, penal action is taken against the concerned doctor. Following this, you can file a complaint against the doctor for alleged medical negligence with the Consumer Forum to seek appropriate relief and compensation. While you can directly approach the Consumer Forum, having a medical board report from a statutory body like the Dental Council significantly strengthens your case. It is advisable to initiate the complaint with the Dental Council to obtain an inquiry report supporting your allegations. Consulting with a legal professional experienced in medical negligence cases is recommended for further guidance and steps.
Thankyou

A.Dear Client,
To prove medical negligence or professional misconduct against a Doctor or medical practitioner is the toughest procedure that often fails on the ground technicalities and procedural mandates. The state-specific Dental Council issues certificates of practice to a Dentist upon obtaining the required degrees from a recognized medical college or Institute. So, before knocking on the door of the Consumer Forum, you have to make a complaint before the Ethics and Penal Committee of the State-specific Dental Council and based on their inquiry and investigation into the complaint, if it is proved on the face of the record that medical negligence is caused on the part of a Doctor/Hospital in the treatment of the patient victim, then they take penal action against the concerned Doctor informing the final report of investigation to the complainant. Based on that report, you may file a complaint against the concerned doctor over alleged medical negligence before the Consumer Forum seeking appropriate relief and compensation for the injury or loss caused out of medical negligence. You may also move your complaint directly before the Consumer Forum but in the absence of a medical board report from a statutory body, your complaint over medical negligence may be allowed or may not be allowed by the Consumer Forum. So, it is recommended to make a complaint of medical negligence before the State-specific Dental Council to obtain an inquiry report that supports your allegation and ensures you appropriate relief from the Consumer Forum. Reach out to an Advocate experienced in medical negligence cases for guidance and steps.
